Im a legal student and doing my term paper on different types of fraud. If a military spouse admits to entering into a marriage for the benefits its clear that the soldier would be put through the ringer but what happens to the spouse?What happens to the military spouse if she confides to an attorney that she is in a contractual marraige?Nothing. Being married is a legal relationship that exists without regard to motives. One is free to marry for pecuniary gain, if one is also willing to accept the limitations that come with being married. Furthermore, if the spouse is the client of the attorney, anything said to the lawyer in confidence will not be repeated.What happens to the military spouse if she confides to an attorney that she is in a contractual marraige?I'm unaware of any laws restricting the motivations people may have for getting married. Nothing will happen to the spouse. She is legally entitled to benefits as soon as he marries a soldier, regardless of the reason she married him.
